Creating an Enforceable Marriage Contract in New Jersey

For a prenuptial agreement to be enforceable in New Jersey, it must be:

  • Voluntarily entered in to
  • Be in writing
  • Have a statement of assets attached to it
  • Have full disclosure of assets (no asset hiding)

In order for the agreement to be enforced, both parties must have had an opportunity to have the agreement reviewed by counsel of his or her choice. The court will determine whether the contract is enforceable based on whether or not the document was unconscionable (unfair) at the time it was entered in to.
